My current plan is that people can just grab the avatars from the old forums then use them for the new. At least as it stands now my plan is to give users full control over their avatars, titles, and signatures.

No lawsuit necessary. Don't take someone else's forum handle, with potential to ruin someone's reputation in and out of game.
