Even if they nerfed all toons down to 1 Damage Per Swing, it would not be "class action material."

Although I agree that lesser hearts should be given to all characters with any of the TWF feats.

How about spending real life dollars to change a character based on a ruleset only to have those very rules changed significantly without refunding said dollars and reverting the changes.

Many a class action has been filed based upon this concept, so plenty of precedent out there. As for what the TOS says, that really doesnt matter much, contracts dont magically fully protect you against civil action or the law, private or not.

Besides that wasnt really the main point of my post LOL.
