If these kids were minors they were likely released into the custody of thier parents, they didn't assualt him correct only took his property, they may have been suspended from school but they didn't see the inside of a jail maybe a holding cell but not a jail.

If this is a small town more than likely a local justice either came to the station or they brought the kids in before him (with parents present btw) filed a restraining order and ror'd them to thier parents, That can happen in an afternoon.

I came here for help to the forums because in real life, I didn't have the support or answers and I was literally scared of getting my ass whooped.

After I posted this, not only am I taking Martial Arts inrl, but I learned enough to help me remember what to do next time in a situation like this.

Ok if you all think that the end result was a bit too drastic, let me sum it down to what the police told me when they handed back my iPod.

"Son, we have your iPod, Those two kids are going to get arrested for theft and you will be given back your possession once we verify it."

Then I asked "Won't they take retribution on me." [Yes, someone posted something along those lines, and I thought i'd repeat word per word what you guys gave me as input.]

He replied "No, don't worry about that, we are going to have a pretty strong talk to them about messing around with you or any future kids, if ANYTHING happens to you, we'll be going back to them and they'll be charged for even more serious issues."

After that, school continued, got my iPod back after school.

The 2 weeks in jail thing, my principle DID say they would be out for 2 weeks and won't resume their school year until the next semester starts and although I don't know where people go after they've been arrested, especially a 9th or 10th grader, i'm assuming Juvie but I still don't know, I assumed it was jail and posted it.

And the restraint order, the police clearly said that they are not to be within 5 ft of me, he clarified it by saying they can't come up to me, they can't talk to me, and they cannot even look at me funny. Because in that current situation, the cop knows something might just happened to me and he knows that I was sort of freaked out so i'm pretty sure he was just trying to assure me.

Overall, this is NOT a fake thread, actually happened, and i'm sorry if you still thinks it's fake, thanks for anyone who truly gave me advice on how to deal with this.

Ok, that's a different set of facts than you said in your last post that triggered people to think you were lying.

It is entirely possible that they were given a restraining order within 24 hrs.
It is entirely possible that they were given a two week suspension from school based on your complaint and their arrest.

It wasn't possible that they were both given two weeks in jail - no time for a trial.

I'm willing to assume you just didn't fully understand what was going on and jumped to some wrong conclusions. The lesson here is tell you what you know, don't add facts you aren't sure of on top

Good luck to you and glad things turned out well.

I had my Ipod stolen at school once. Except I was the teacher.
Jokes on them though, it was 3 years old and barely worked.

On a completely unrelated note, all borderline-failing students did in fact fail in that section. Man kids are so dumb sometimes.

Hmm...that makes you sound dumb. Why would you assume it was a borderline failing student that stole your ipod and punish them? It could easily have been an A student (they act out too you know). You sound like a lousy teacher.

I'm too lazy to read the entire thread. Did anyone get their teeth knocked out? Or did this have a "happy , cute fuzzy, politically correct, Counselor Troi " ending?

This is a no-brainer. Make a COPY of the receipt -- do not bring the original. If a credit card was used, black out the card number completely on the copy.

Second, if they refuse to give you the ipod back, you have TWELVE witnesses. Ask your friends if they will testify to the police. If they will, twelve individuals stating that one individual did an illegal act = CONVICTION. The police will hunt him down. He will get community service and I'm fairly certain he will be buying you a new ipod if he fenced your old one.

The only question you need to ask yourself is this: will this kid in some way be able to get retribution, etc? Is he a gang member, etc? Can you defend yourself if he tries to take it out on you later? These are unfortunate questions you have to answer. You should not be bullied around, but you may need to pick your fight correctly. Don't be a target. Don't allow yourself to be in a vulnerable situation and for heaven's sake don't allow your ipod to be nabbed from your hand by anyone you don't know! Hide it if there's potential. Keep it in your front jean pocket. Most people are not willing to play pocket pool in order to grab your ipod. If they are, you can get them on a much more serious charge than just stealing your ipod.

I don't know how physically capable you or your friends are, but if this is a common theme, I would find a dojo of a reputable self-defense instructor and get street smart so people can't take advantage of you or your friends. Violence is a last resort: file the police charge first, but be able to defend yourself if they come to pound you later. Also, if guns are involved, you can't win against an idiot with a gun so don't allow the scenario to occur.

LOL right on. Meh, my advice wouldn't be "correct" anyway. It would involve a pig farm , rope, and shovels.

yeeesh... this kinda stuff is still going on?

    In my opinion:

you did the right thing. best to walk away. its only a thing, things can be replaced. however you have reached an agreement, and he is bound by it. if you provide proof, and he does not aqueous the item back, then you call the cops right there, get the principle, get your friends go the whole nine yards on the individuals. nail them to the wall.

Guess who is his son's teacher? My wife! I'm recommending to her to have the little jackass tossed.
