I seem to be pulling agro a lot even when not attacking a mob and see the intim icon appear above mobs heads before they squish me. just wondering what is causing this I am use to it with something like a marut as they hate rogues but I'm getting it against nearly everything now.
I did max out my intim skill but only for dialogues I don't put it on my hotbar or use it at all since I'm not exactly built to tank..
is this new that it has become automatic or is it that mobs just hate rogues?
been a while since I played a rogue but I don't remember this ever being a problem.

Do you have any form of aura? Paladin, fvs?

Are your teaming up with a monkcher?
If the hated player character is unreachable by the mob, he will change aggro to the nearest reachable player character.
When this aggro change happens, there will show an "intim" icon over the head of the mob, as if it has been intimidated.
This is just the mob releasing the frustration we all have when we see a monkcher (and we're not playing one), though.
Also, if your rogue is a halfling, that would explain a lot too. =D

i'm a sun elf pure rogue. this has happened no matter who i team with even in a room where mobs can get to anyone. happened in outbreak with the plants not sure we had a monkcher or any other aa in group shiradi casters and even proper paly tank trying ot keep agro but it kept going after me so i was doing lots of running and hitting my heal scrolls without any time to even attack don't think i attacked the boss once as I was taking care of trash but it always seem to hate me. at any rate I just epic reincarnated and put 0 points in intim this time so I'll see if that makes a difference.

A developed said something about mobs attacking casters first, then rogues and then the other class in some sort of order. If you were standing right beside a Fighter the mobs would target you and not the Fighter.
Intimidate has nothing to do with any of it.
Although some players completely disregard it, Diplomacy may help you in situations like these. Pick up "Faster Sneak" enhancements and stay stealthed always when you can. Consider the "Sap" feat or some sort of instant CC.
Also, it might just be that you're squishy and it feels like the whole world is against you when 1~2 mobs lay 1~2 attacks on you.
Running away doesn't shred aggro unless your friends come to help, the monster will keep attacking you.

Not that it always works, but I recently built a rogue to help a buddy on the TR train, and "knowing your role" help a lot. I maxed out my trapping and faster sneaking enhancements, and generally stay in sneak mode, allowing the stronger builds to open doors (after I've untrapped them) and draw aggro. Once they start fighting I pop in to assist. I built a mechanic repeater rogue, so I tend to shoot at enemy, tab target to the next and repeat as long as the encounter lasts. The reason I don't focus on an enemy is that I'm trying to keep aggro to a minimum while contributing to the overall effort. I still manage to draw some aggro, but I can usually handle one enemy at a time on heroics.
As a dwarf, my CHA is too low to make an investment in social skills without gear. I basically dumped diplomacy and bluff in favor of trapping and UMD. If i have points, they're essentially wasted now that I don't keep bluff maxed out.
I found that aggro is harder to avoid as an assassin. If I fail an assassinate attempt, I'll almost certainly be faced with an angry opponent without the benefit of sneak attack damage. I have found that a tank/assassin DPS combo is quite effective. Hang back a bit and allow the tank to draw aggro, then work in tandem with sneak attack damage getting maximum effect. This strategy is far less effective on epic hard and all but useless on EE, but pays dividends in heroic content. The goal is minimize personal aggro and allow the tank to do his/her job. Inevitably someone will get mad at you when you fail to kill them, but if a good tank keeps intimidating, you can just focus on making the rounds.
Maybe its just me, but I feel that there's an active agenda to making sure rogues stay gimpy and have weak abilities to prevent them from becoming a powerful class. As a mechanic, my alchemical traps are terrible. I've just chalked it up to accepting that I'm there for never fail trapping and allowing the casters and warriors the glory of battle. Its easier to swallow when you're partied in a static group. I wish that thunderstone might actually have a reasonable stun effect, and time bomb didn't move in slow motion. I barely use the abilities because of this.
I tried acrobat, thinking that tripping enemies would be great, but again, the DCs are junk.
