I wanted to splash my bard with 1 lev cleric to get Divine Vitality but it requires 2 lev of cleric. I consider it as a bug because it is on the first tier of Divine Desciple tree.

Seems more like an issue of no room to put it on the second tier.
This isn't the only enhancement like that either.
