Epic Toughness Feat problem

Hello all,

Drmerlin here lvl 27 drow elf pure wizard,

A question please.

Why on this toon can I not have the epic toughness feat as I have the toughness feat but my bas con is 16 and yes it states that you need a base con of 21 ok fare enough???

Then why does it allow on my other toon a lvl27 pure WF Cleric with a base con of 16 to tkage the epic toughness feat??? and not on my wizard?? is this a known bug? or issue?

Your advice on this would be most helpful please.

Does your cleric have a +5 Con tome? 16+5 = 21
