Before I can give feedback on the build, I need to know what your game plan is.
Melee - You have no melee feats.
Instakill - You stat dumped your DC stats.
Direct damage - Your equipment and the spell pen feat don't go with this direction.
Based on what you describe as your general desire and the fact you posted a con based build, I would recommend you try a human 18 FVS/2 Pally (Saves are really important, and your gear isn't there yet) and look at the build advice in the NovaSoul thread (see my sig).

Well im not going for melee, as it stands now im going for a instakill / healer FVS with some damage on BB and cometfall. I would like to stay single class (going pally wont add too much saves, since my cha isnt that ridiculously high).
also I have a correction for your post: FVS DC is only 10+level+WIS. only wis.

I can understand going for single class. The capstone is nice until you get enough twist points to twist in cheap healing. However you work through it, you are going to need saves and every bit helps. Reflex is one of the most important saves, and dumping dex means you start off in the hole. I went with Pally Dil on my half-elf, and even though it is only +5 to saves, that +5 was huge when I started soloing EE's. Epic hards are a lot more forgiving, but in general... failed saves are the only thing that can kill a con based FVS in epic hard.
Your DC comment has me confused. I don't think I ever talked about FVS spell DCs, and the DCs for SLAs (those that have saves) are not the same as the spells. The text for the SLA spells out how the saves work (if there is a save). Both energy burst and avenging light accept CHA as a DC stat. The only comment I can see that is talking about the DC value is my note right below avenging light talking about the avenging light DC. Avenging light is a SLA, the FVS spell DC has nothing to do with it.
As far as your offense. BB and cometfall just pale in comparison to epic destiny offense. Avenging light, toss boulder, wild shot and energy burst cost less, do faster spike damage and on epic hard... that spike damage is usually enough to kill.
Is this a theory build that you haven't played yet, or an existing character. If the character exists, how is it going using BB and cometfall? If you are fine with your offense... go with what works for you.

This is my current main, and atm my BB and cometfall are pretty good, around 800 per pass / cometfall.
yeah and about DC I was referring to regular spell DC's, silly me.

Problem is, that 800 hp isn't as much as it used to be. The spells have not scaled well. To do that 800, you probably need/want max/empower/heighten (maybe quicken). How many of those can you cast on one tank of gas (spell points)? In Giant hold, one cast for 800 may not be enough to kill.
Contrast this with now you have fighters hitting for 800+ in one swing without spending mana. Wild shot does 500-1k for no mana, toss boulder does 1-2k for no mana. Divine wrath does 1k+ damage and heals for 30 spell points (metas are free).
The general state of spells, especially DC spells is a mess right now. The best builds at the moment are min/maxed around the concept of what can my base class best offer my destiny. In the case of Jugg, Arti provides extra feats, bonuses to item use, great skills, solid self buffs and self healing. The damage comes from multi-shot and the epic destiny. Similarly, Arcane's posses the best engine (cheap no save force spell spam) to produce shiradi procs. For a FVS, you have 3 general options (as I stated in my first post of the thread). DC based, Melee based or direct damage based. DC based is a very demanding route that at the end of the road currently produces questionable results. Melee based can do ok, but FVS as a melee base class no longer compares favorably to what other classes offer. With epic destinies, anyone can self heal... others have self buffs and many classes get bonus feats which are valuable to a melee build.
The direct damage build has good synergy with the AoV PRE and the ED SLAs. It is not top of the line, but it is far far easier to gear than a melee build. Comparing the effort of gearing a DD build to a DC build is like playing a completely different game.
It is one thing to post theory in the forums, but truly the best way to find your class is to simply play. I strongly recommend catching some time on the test server when Turbine wants something tested. You give them time testing their latest bright idea, and in return they give you an environment where you have a throw away toon that you have the freedom to LR/TR repeatedly without spending money. The end result is you don't have a build you think you might like... you have one you have played and know you like.
