Today i noticed that my druid Shalera (of Orien) (level 20 druid, 3 epic (though am banked to level 5) had fewer spell points than it had the previous day.
When i started looking for the reason, I looked at the obvious ones...
I stripped totally down to as naked as when i landed on the beach, and still i seem to be missing spell points
When I look at the spell point break down, I notice a item "Negative Level Penalty" however, since I am naked, it can't be a piece of gear...
I then think maybe it is related to epic destiny so I try swapping between them, still have penalty.
What is causing this penalty and how do i get rid of it? This penalty ranges from between 197 - 244 spell points depending on gear/destiny currently in.

Have you tried relogging? Some EDs have buggy behaviour, especially with regards to SP total. Relogging usually resets this.

Had this problem as well, but with Dreadnaught and HP... Hehe lost like 200 and was freaked out. Logged out, back in, and voila, had my HP back. :D

Didn't know it could affect HP too, yikes!

With me, it affected it in a positive way. I've had 10 more maximum HP after switching from legendary dreadnaught to shiradi champion, than I should have had. After a relog, the HP was corrected.

I tried relogging, including switching destinies before logging and still no change. I had issues with disappearing spell points before but they always seemed to be cured by switching destinies. I also tried relogging while naked, etc... I considered trying to file a ticket in game but was unable to access the help section ( it was just black)
I would assume a negative level penalty would also affect hp, but this is not being seen.

That might mean in-game support is no longer available (http://forums.ddo.com/showthread.php?t=236600) until you give Turbine more money. I have two premium accounts, one that purchased Turbine Points recently and one that hasn't. The one that spent money recently is able to access in-game support while the one that hasn't just gets a black screen like you describe.
I would try posting in one of the "Support & Assistance" (http://forums.ddo.com/forumdisplay.php?f=105) forums.
Hope that helps.

Actually, the problem is that 21+ characters cannot access the help screen at the moment.

I heard of some people with this problem... Leveling up their destiny seems to fix it. Once you level up, the numbers seem to reorganize and show up properly again.

Precisely.
I would have thought that this would be their #1 Priority fix!!
I mean really Turbine!?!?!?
My "help" screen has been blank since U14 launched. You want bug reports? Then please fix this. I can't access anything in the "help" section at all.

Even more interesting. If you add those up the negative level penalty is actually giving you 197 SP not taking them away. Maybe you should just keep quiet about it. :D

Based on my observations, it seems like the Exalted Angel +10% SP ability is causing this.
On login, the total is usually fine. Pretty much any time I mess with my EDs though, it reapplies the bonus, recalculates, and comes out wrong.
Its fairly obvious...when I apply the 3rd tier of that ability to go from +7% SP to +10% SP and my max SP ends up being 50 points lower.

1,125 + 319 + 535 = 1979
1979 * 10% = 197 (rounded down)
The "negative level penalty" seems to be that 10% bonus from epic destiny.
note: I don't really know anything about destinies, just going off of two above posts.

I think you're right.
Negative Level Penalty seems to be used generically for bonuses/penalties that have no text of their own, as far as I can tell.

Stalwart Defender +10/15/20% bonus HP also displays as a "negative level penalty," even though it's actually a bonus. It's lazy scripting. Devs should label it more accurately.

Ah, I have the Exalted angel 10% sp twisted into my build so I guess it is calculating them correctly - stupid way to describe it though... Stupid destinies do wierd things with sp...
