This is the way it works in PnP, so let's see if anybody can convince me otherwise.
In pnp, any random die roll portion of a spell can be both maximized and empowered. For example, Ray of Enfeeblement: you may maxmize/empower the D6 roll, but not the +X bonus for caster levels. Enervation: You may maximize and empower this spell. Cloudkill: you may maximize/empower the CON damage from the spell. Energy Drain: various PrE's can get this cast with both maximize and empower.
