They don't work now, and they didn't work on the mod 9 beta.

You are correct that they should work in mod 9, to the same degree that the Contagion and Poison spells could work on a red named boss. Now that red names have a different defense from ability score damage, they don't need blanket immunity to poison and disease.

However, since the devs made bosses immune to the Trembling Earth debuff, they would clearly also want them to be immune to the spellcasting debuff from Assassin poison too.
